20. Choice of Law and Forum

This Agreement is governed by the laws of the State of Georgia, United States of America. Subject to the dispute resolution provisions below, you consent to the sole and exclusive jurisdiction and venue of the courts located in Georgia.

21. Dispute Resolution by Binding Arbitration

You agree to attempt in good faith to settle any dispute or claim that has or may arise between us (related to these Terms or your use of the Site) through consultation. If such dispute cannot be resolved within 30 days of notice, either party can initiate arbitration.

YOU AGREE TO ARBITRATE ALL CLAIMS BETWEEN YOU AND US THAT CANNOT BE AMICABLY RESOLVED. THIS AGREEMENT TO ARBITRATE IS INTENDED TO BE BROADLY INTERPRETED, AND YOU AGREE TO WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

• The arbitration will be governed by the American Arbitration Association (“AAA”) Rules, and administered by a single arbitrator with relevant industry experience.

• Unless otherwise agreed, the arbitration hearings will take place in Georgia.

• Opt-Out: You may opt out of this arbitration provision by sending written notice within thirty (30) days of your acceptance of these Terms to info@enablerstech.com with your name and address, and a clear statement that you do not wish to resolve disputes through arbitration.

If any part of this dispute resolution section is found invalid or unenforceable, the remaining portions shall remain in force, except if the class action waiver is found unenforceable, this section shall be null and void.

22. No Agency

No agency, joint venture, or partnership is created between Enablerstech and any User or Provider via these Terms or the Site.

When we need to send notices to you, we will use the email address you last provided to us.

24. Amendments

We may change, modify, add, or remove any portion of these Terms, in whole or in part, at any time. Changes will be posted on the Site and will be effective immediately. Continued use of the Site following any changes constitutes acceptance of the updates. These Terms (including our Privacy Policy and E-SIGN Consent) form the entire agreement between us and Users.
